Terms & Conditions

These terms are a plain-English summary intended to safeguard the interests of both AuctionsNOW and our users. They are not legal advice. The definitive terms are the version published at the URL above on the date you accepted them. We may amend these terms from time to time and the version in force is the one shown at the time of any transaction.

1. About us

AuctionsNOW is a marketplace and live auction platform operated by AuctionsNOW Pty Ltd (ACN to be confirmed), based in Euroa, Victoria, Australia. We facilitate the listing, sale and auction of farm machinery, equipment, vehicles, commodities, livestock-equipment and related goods between independent sellers ("Vendors") and buyers ("Buyers").

Unless we expressly state otherwise on a particular listing, we are not the owner or seller of any goods listed on the platform. We act as an intermediary, providing the marketplace, payment facilitation, dispute support and (where applicable) auctioneering services.

2. Eligibility & accounts

  • You must be at least 18 years old and capable of entering legally binding contracts under Australian law.
  • You agree to provide accurate, current and complete information when registering or listing.
  • You are responsible for keeping your account credentials confidential and for activity under your account.
  • We may verify your identity, ownership of goods, and (for businesses) ABN, GST status and finance encumbrances. We may suspend or terminate accounts that fail verification.

3. Listings - Vendor responsibilities

By listing an item on AuctionsNOW you represent and warrant that:

  • You are the legal owner of the item or are authorised by the owner to sell it.
  • The item is free of any undisclosed encumbrance, lien or third-party finance, or any such finance is fully disclosed in the listing.
  • The description, photos, specifications, hours, year and condition shown are accurate and not misleading.
  • You will respond to enquiries in good faith and honour offers accepted through the platform.
  • The item complies with all applicable Australian laws, including roadworthy, biosecurity and chemical-residue requirements.

Listings that breach these warranties - whether through inaccuracy, omission or misconduct - may be removed without notice, and we reserve the right to recover from the Vendor any costs, refunds or losses we incur as a result.

4. Buyer obligations

  • Inspect items before purchase wherever practicable. Bids and accepted offers placed through the platform are binding.
  • Settle within the timeframes published on the listing or the auction terms (typically three business days).
  • Don't use the platform to harass, defraud, or attempt to circumvent payment facilitation by transacting outside AuctionsNOW once introduced through the platform.

5. Fees & commissions

Listing on AuctionsNOW is currently free. Where a sale completes, we charge a commission to the Vendor on the final sale price (rate displayed at the time of listing). Live auctions and clearing sales may attract additional auctioneer or buyer-premium fees, which are disclosed before bidding. We reserve the right to change our fee structure on 30 days' notice; existing listings retain the fee structure in force at the time of listing.

6. Our role & limitation of liability

AuctionsNOW provides the marketplace on an "as is" basis. We do not guarantee the accuracy of any listing, the conduct of any Vendor or Buyer, or the suitability of any item for a particular purpose.

To the maximum extent permitted by law (and subject to non-excludable rights under the Australian Consumer Law):

  • Our total aggregate liability to you arising from your use of the platform is limited to the commission we have received from the relevant transaction (or, if no transaction, AUD $100).
  • We are not liable for any indirect, consequential, special or punitive loss, including lost profits, lost data, or business interruption.
  • We are not liable for the acts or omissions of Vendors, Buyers, freight providers, finance providers or any other third party introduced through the platform.

Nothing in these terms excludes or limits any right or remedy you may have under the Australian Consumer Law that cannot be lawfully excluded.

7. Buyer protection & trust account

For eligible transactions facilitated through the platform, payments may be held in a trust account until the Buyer takes delivery and the agreed inspection period elapses. Eligibility, limits and the dispute process are set out in the Buyer Protection schedule available on request. Buyer protection is not insurance and does not cover wear, post-delivery damage, or items where you waive inspection.

8. Intellectual property

The platform, including the AuctionsNOW name, logo, software and editorial content, is owned by AuctionsNOW Pty Ltd. By posting a listing you grant us a non-exclusive, worldwide, royalty-free licence to display, copy, distribute and promote the listing content (including your photos and descriptions) on the platform, in our marketing and on syndication partners until the listing is removed.

9. Privacy

We collect personal information to operate the platform, verify users, process transactions and provide buyer protection. We handle that information in accordance with the Australian Privacy Principles. We don't sell your personal information. Contact details are not shown publicly on listings - they are shared with the other party only after an enquiry, offer or sale.

10. Suspension & termination

We may suspend or terminate access to the platform without notice where we reasonably suspect fraud, breach of these terms, abuse of staff or other users, or where required by law. You may close your account at any time by emailing admin@auctionsnow.com.au; open transactions and obligations survive closure.

11. Governing law

These terms are governed by the laws of Victoria, Australia. Any dispute is subject to the exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia.
